Dear Ms. Alpa Sheth,

I appreciate your concern about the implications of RERA on Structural Engineers.  I am sure you will receive good response from SEFI members.


I am equally concerned about the implications of GST rules that would be effective from 1st July 2017, on structural consultants and software suppliers.  Although the rules mention about threshold limit of Rs.20 lacs in one place and Rs.9 lacs in another place, but when structural consultants and software suppliers provide inter-state service, then the threshold limit doesn't arise at all, and one has to do GST registration not only in the state where one has the office but also register in all other states of India where one does the business.  Once registration is done, then there will be feeding of all the invoices to the centre and state governments monthly/quarterly and finally annual returns even if one's annual turnover is less than Rs. 9 lacs.  This procedure is too harsh on small professionals who have a small layout to do this bureaucratic work.  As of now, Service Tax is provided only when the annual turnover is over Rs. 9 lacs and no registration for service tax is required if the annual turnover is less than this figure..  


I had posted on the above topic (Change.org petition) in the SEFI discussion forum, but only about 190 members have seen it without any reply.  I find that not many CAs in Mumbai are fully aware of all the GST rules.  SEFI members who are doing structural consultancy work will have to study the GST rules thoroughly and be prepared to handle it from 1st July 2017.

RERA-
Real Estate Regulatory Authority Act
Definition of Engineer
(Definition of Engineer)-(Herein Engineer means Civil Engineer)

‘Engineer’ means a person, who possesses a Bachelor degree or equivalent from an institution, recognized by All India Council of Technical Education or any University or any Institution recognized, under a law or is registered, as an ‘engineer’ under any law for time being in force
Foregoing definition mandated within RERA is completely speakingless
It does not describe, who an engineer is to practice Real Estate discipline
It mandates that person possessing a degree in engineering can be called an engineer
This means today, one gets pass of engineering degree. w.e.f next day, person is entitled engineer!!!
How can this definition be accepted for an engineer to practice Real estate?
But lawmakers have approved it for this purpose
This is a caused risk of life endowed on public safety by RERA
Now, there is no alternative to deplete this definition from this published Act
This shall support promoters, who would employ fresh engineers
This means that there is no guarantee to deliver quality residences
No registration of engineer is required by any authority say The Institution of Engineers (India)
It also, means that no one from ministry /GOI/ even thought to consult any Institution
No role of Engineer is defined, except that percentage of work shall be submitted in addition to submission by an Architect
Is this way how laws are enacted in 2017?
There is no explanation within this Act about who shall supervise design & construction of projects
Promoter shall certainly benefit from this incomplete Act
It is now up to prospective buyers to look after their interests

RERA+ Structural Costing
That 70% of amount released for real estate project from allottees from time to time shall be deposited in a separate account to be maintained in a scheduled bank to covercost of construction & land cost & shall be used only that purpose

Provided that promoter shall withdraw amount from separate account to cover cost of project in proportion to percentage of completion of project

Provided further thatamount from separate account shall be withdrawn by promoter, after it iscertified by an ‘engineer’, by an ‘architect’ & a chartered accountant inpractice, that withdrawal is in proportion to percentage of completion of project

Comments

70% cost includes costof land also

In many cases, cost of land is very high, which shall leave real cost of construction too low, which shall mean that valuation of work done by promoter to be certified by Engineer & Architect would be too low from time to time or at fixed interval

Cost shall be fixed element wise & level wise in form of work done & cost related to one time calculated rates, based on material & labour cost information

Each element shall be weighed accordingly say RCC structure, which constitutes of excavation, soil improvements, foundations, work of all floors separately & individually upto level of final structural completion

Relevant cost of each element shall be worked out to be included with proposed list of all structural components

Then just, engineer requires to tick element & assign percentage of cost achieved, depending onwork carried out percentage

Dear Sefians,

The term 'Structural Defects' in RERA needs to be clearly defined as the common man has no understanding or different meanings of it.

In my opinion, this term should be restricted to displacement and cracking of structural elements like Slabs, Beams, Columns, Joints and Foundation beyond a permissible limit which could be spelt out in RERA rules.  It should not include damages to non-structural elements like doors, windows, brick panel walls.

It is also the responsibility of the residents of the buildings in not misusing the building by way of making structural alterations, over loading the floors with heavy storage materials. The residents should also maintain the buildings properly and regularly, particularly with the leakage of roofs and drain pipes.

If the above matter is not properly defined in RERA rules, there would be unnecessary litigation with the property developer and the structural engineer.

Dear all,

       We all should welcome this act.Though the act is seems to be somewhat Cumbersome and tedious instantaneously,but in long run,it will make the field to run in a professional way.The role of Structural engineers is very vital.The commitment is very high.The engineers who used to sign and issue the certificates without designing and for obligation,they should be very cautious.Through knowledge and proper detailing are essential needs for the Structural engineers.I suggest SEFI to develop on line courses with the experts in the field on Practical orientation in Structural engineering.The CPD proposed by Engineering council of India is very good and will be highly helpful for Professional regulation.Similar procedure for all structural engineers is to be proposed so that every structural engineer will equip with State of Art technology.

Dear All,


While there would be only one Architect and one Charterd Accountant for a project, there could be sevaral independent Engineers associated with it. Namely,
1. Structural designer
2. Construction Engineer, in charge of executing the project
3. Electrical Engineer
4. PHE design engineer
5. Foundation specialist
6. Stormwater Management Consultant

7. Quantity Surveyor
8. Grade and Roads Consultant
9. HVAC Consultant, etc.,


Each of the above mentioned specialist engineer have a well defined and important role during the construction. Their role would also have a bearing on the quality, for which the Developer shall be responsible for five years after project completion. The Act just mentions "Engineer", for cost certification, which in my opinion comes under the preview of Quantity Surveyor. As other Engineers roles and responsibilities are not defined in the Act, it is difficult to comment on impact on Structural Engineers. Having read through the Act, I do not see anything specific or otherwise, related to Structural Engineers in it. In case I am missing it, will appreciate if someone can point it out for our benefit.


There is a rumour that many of the State Governments may end up diluting the provisions of the RERA under pressure from Developers and Builders. I wish they don't, and even if they do, the buyers will build up counter pressure forcing the governments to keep the Act intact.


In most of the projects, it is the Architect who chooses other Consultants and appoints them directly. In my view, if the Architect is considered as the Prime Consultant, than the primary liability shall lie with him/ her only.

Why we structural Engineers paid minimum fees ?

In fact We the structural engineers are the one who paid least fees from consultant involved, from labour to Architect and developer.
though we have inversely maximum responsibility, if building will have any structural defect or collapsed during earth quake or high wind, we will be the who will punished.
We all knows rate of labors,furniture makers,interiors,architects,plumbers,
As per my Opinion we must have equal fees standard throughout India for least price, and at least
same as architect's fees.Just for to mention: In medical line, practicing doctors kept fees standard same in Gujarat,as I know, I'm from Gujarat. Doctors have very less responsibility than us.
Why ? what would happen
If we mistake in calculating earthquake forces or ductile detailing,If we mistake in calculating FOS in Dam,If transmission line tower fails in buckling or in any other condition.and many more in all type of structures...

Let me know who's agree with me.
