Engineer Defined-
Stop registering with Municipalities/Local Bodies
Stay respectful professional

Real Estate Regulatory Authority Act 2016 now in effect from May1, 2016 within India/Bharat Jurisdiction except state of Jammu & Kashmir

Certain Professional Engineering Observations from quality point of view

Section 2(u)
(Definition of Engineer)-(Herein Engineer means Civil Engineer)
‘Engineer’ means a person, who possesses a Bachelor degree or equivalent from an institution, recognized by All India Council of Technical Education or any University or any Institution recognized, under a law or is registered, as an ‘engineer’ under any law for time being in force
Comments/Interpretation
All engineers working on buildings, please stop taking licenses from municipalities or authorities for Engineer has been defined within RERA though it is not scoped, yet registration with every authority can be defied with
Fight with all to gain power & respect
You can use reference to your engineering degree certificate & also, whatever registration you have got from IEI or otherwise, but duly recognised
Authorities are now bound not to force engineer to apply for departmental licensing
Rest up to you, whether you are lion or a cat!!!

This Implies If we have AMIE membership we can practice engineering works anywhere within India (except J&K) is that Right?

What if I wish to work as Structural designer, is any other Licensing required?

RERA Provision-Engineer

Per statutory definition of Engineer in RERA's implication, no requirement for further registration

Though, by oversight, it has been included within this statute, but now it is part of our law & no one can change it, other than parliament itself

So stand open to all those, who issue illegal licenses that there is no need for their licenses & that they cannot stop you from using this designation

Use your registration seals with IEI or other recognised bodies to which, you subscribe
Engineer seal is adequate, per this Act to work on structures

National statute supersedes all other state level laws & regulations to an extent definition of Engineer is related

This is a constitutional provision that state provisions are superseded, when national level exists

Even degree certificate references can be used in line to Engineer definition

If authorities do not accept, let them give documentary denial, so that they can be served upon with legal notice, prior to commencing court proceedings

This is first time that definition of Engineer designation has been published, within a statute for building engineers

Architects too cannot object to this provisions for Architect definition too exists therein

Now their arrogance that SCI had ordered that only architect can practice on architecture is not impacting on activities related to civil engineering on buildings

Let them go to contest in SCI if they do wish  to
Engineer definition applies to all disciplines of engineers applicable on buildings

Engineer should have courage to dispute with officers & not act as wet cats

Sir,
In my opinion, model RERA draft is adapted and adopted by each state and not enforced by a central authority. Moreover, within each state, local bodies have their own bye laws which require registration of engineers in their jurisdiction. So it is status quo as far as engineers' licence is concerned.

On role and responsibilities of a Structural Engineer on a project : Views of  CASE :  

The Council of American Structural Engineers (CASE) defines a structural engineer as: "An engineer with specialized knowledge, training, and experience in the sciences and mathematics relating to analyzing and designing force-resisting systems for buildings and other structures." A structural engineer usually has one of two roles on a building project, as identified by CASE:

I)  The Structural Engineer of Record (SER)"perform or supervise the analysis, design, and document preparation for the building structure and has knowledge of the requirements for the load carrying structural system." The SER is responsible for the design of the primary structural system, which is "the completed combination of elements which serve to support the building's self-weight, the applicable live load which is based upon the occupancy and use of the spaces, [and] the environmental loads such as wind, seismic, and thermal."  

2) A Specialty Structural Engineer (SSE) "performs   structural engineering functions necessary for the structure to be   completed and who has shown experience and/or training in the specific   specialty." The SSE "is usually retained by a supplier or   subcontractor who is responsible for the design, fabrication, and   (sometimes) installation of engineered elements or by the general   contractor or subcontractor(s) responsible for construction related   services." Common examples of such elements are precast or tilt-up   concrete, open web steel joists, pre-engineered cold-formed steel or wood   trusses, and metal building systems.

Whatever further state Acts should be, would be in line to these prime statutory provisions
This Act defines many terms, 'Engineer' being one of these
'Engineer' term cannot be defined varying from place to place
Once prime Act provides something, secondary State Act provision is superseded
In case, state intends to continue with its provisions, specific permission is required from president of this country per COI provisions
Professional designations are covered in Concurrent List, which priority goes to Central Act by operation of law
Rest construction of this term up to your understanding, as you wish
My little knowledge has explained my mind

As I understand, RERA is an act of parliament but each state must notify  their own rules. For example, Maharashtra has  notified five rules and three regulations and orders.
Again, as per my understanding, definition of engineer in the act is for a limited purpose of RERA which has no  jurisdiction overarching local bye laws such as permissible FSI,  licensing of professionals etc.

Dear all I agree with rudra menaria as regards definition of engineer. Local bodies can still require registration of engineers. 


However I feel that with they will have limited jurisdiction to define an engineer where the definition of Act shall be  governing.


Simply put now local bodies may not be able to register architects as engineers

Unfortunate on part of Indian Civil Engineer, who is unable to understand law!!!
Who allowed states to constitute laws for regulation of engineers?
Where COI stipulates that States got authority to regulate engineers?
Engineers cannot respect themselves & submit to illegal powers!!!
Always critic for sake of doing so
This is an only reason that architects sit on our heads
This is an only reason that engineer can never get respect
Every engineer talks as if he is a genious of law
Engineer neither respects IEI charter nor other provisions
Keep talking & sinking
Nobody can help civil engineers at least in this country
